Chile's new migration law policies

Much has been said about Chilean immigration legislation in recent months, which has caused discussion and even concern among human rights defenders.

My son immigrated to Chile two years ago, before going to Chile, he applied in Venezuela through the Chilean embassy in Caracas for the democratic Visa, it lasts one year and he received a provisional Chilean ID card for one year, at the end of the year he should already have the definitive Visa, but there has been such a large number of Venezuelans entering Chile that the process has been delayed, also due to the fact that the pandemic began.

Although the regulation on migration and foreigners in Chile was approved by the Senate in December 2020, there is still confusion as to whether it is already being applied. The truth is that after that approval, the law is still not in force.

In addition, different groups of migrants and associations of immigration lawyers in Chile have made serious observations on the new law, which has lengthened its debate among the public opinion. Likewise, different media have published information on the implementation of this law, which has generated sensitivity among the population.

Unfortunately, there was an episode experienced in February 2021, when more than 130 Colombian and Venezuelan migrants in Chile were expressly expelled from the country. In this regard, many have wondered if the new law is already in force, and the answer is that it is not.

This means that the Immigration and Foreigners Law in Chile will take a few more months to enter into force. However, all indications are that in the course of 2021 it will finally start to be applied.

My son, thank God, has not had that problem because he is still waiting for his permanent visa, he just wants the new law to be approved so that I can go live with him in Chile, now everything is paralyzed because of the pandemic, we will continue to wait.
