Antonin Scalia (March 11, 1936 – February 13, 2016) was an associate justice of the United States Supreme Court from 1986 to 2016. He was known for his staunch legal conservatism. Scalia was the first Italian-American Supreme Court justice.
Scalia was one of the most powerful Supreme Court justices of his time. One of his most notable characteristics was his ferocious questioning of witnesses during oral arguments as well as his sarcastic and vitriolic criticism of anyone who disagreed with him. Many other legal experts were influenced by his approach to judging to establish their own unified judicial philosophies.
The Death
Antonin Scalia died abruptly on the night of February 12–13, 2016, while on a hunting trip with a group of 35 friends at a West Texas ranch property. He was 79 years old at the time. Cibolo Creek Ranch is a private luxury resort located on 30,000 acres in a secluded area south of Marfa, Texas. Because of the distance, there were some heartbreakingly practical issues. The coroner certified his death by natural causes over the phone, as permitted under Texas law, and the public announcement was postponed (ultimately made by Chief Justice John Roberts on February 13). There was some confusion at first, as well as a brief squabble about who should have custody of the body. On Sunday morning, February 14, a team of US Marshals and Supreme Court Police escorted his body back to Washington, D.C.
The Chaos
Senator Mitch McConnell, the majority leader of the United States Senate, made a public statement shortly after Justice Scalia's death, well before the body arrived in Washington, stating that it would be wrong to name Justice Scalia's successor by President Obama's successor and that it would be wrong to do otherwise.
Scalia's death occurred nine months before the election and 11 months before the next inauguration, which would create an unprecedentedly long vacancy if Republicans did not capitulate. "Failure to fill this vacancy would be a humiliating abdication of one of the Senate's most basic constitutional responsibilities," Harry Reid, the Senate minority leader, said in reaction to McConnell's comments. Republicans fought the word "unprecedented," stating that a Supreme Court confirmation in the final year of a presidential administration would be exceedingly exceptional. They may have been correct statistically, but the majority of vacancies on the Supreme Court are due to planned retirements, and the chances of a justice dying in office in the final year of a president are very minimal. On the other hand, Harry Reid was correct in terms of substance. In any case, the Republicans were not rejecting the president's nominee; rather, they were refusing to acknowledge the president's – this president's – authority to make the nomination.
Meanwhile, President Barack Obama has stated that he intends to proceed. All of this occurred before Scalia's body was returned to the United States.
Scalia has been called one of the most influential jurists of the twentieth century and one of the most important Supreme Court justices in history for igniting an originalist and textualist movement in American law. President Donald Trump awarded Scalia the Presidential Medal of Freedom posthumously in 2018, and the Antonin Scalia Law School at George Mason University was dedicated in his honour.
