Slachtoffers draaien op voor alle kosten bij seponatie verkrachting


Wanneer een dader vrijuit gaat voor verkrachting  of pedofilie , veelal omdat de onderzoeksrechter de gevraagde onderzoeken weigert , draait het slachtoffer op voor de gerechtskosten .


Wanneer de dader ook nog eens een rancuneus persoon is  en zijn slachtoffer  (of in geval van minderjarigheid van het slachtoffer  degene die de klacht indiende) laat vervolgen voor lasterlijke aangifte , draait het slachtoffer ook nog eens op voor een fikse schadevergoeding  aan de verkrachter .




In België is dit de hoofdreden waarom artsen, psychiaters en andere hulpverleners zelf geen aangifte  durven doen.

De kans is namelijk heel groot dat de dader buiten vervolging gesteld wordt  waarna deze zich gaat viseren op degene die het misdrijf heeft aangegeven. 

De argumenten waarom een onderzoeksrechter een verkrachtings--of pedofiliedossier laat seponeren wegens onvoldoende bewijzen zijn uiteenlopend: 

*Veelal is er sprake van seponering van het dossier omdat de dader ooit een amoureuze relatie had met  degene die aangifte doet van de feiten. Denk aan  een mama van een misbruikt kind  die klacht indient tijdens of na  een (v)echtscheiding .


*Zaak is geklasseerd omdat de arts of andere hulpverlener niet verhoord werd . Vaak omwille van schending van de privacy van het kind.


*Zaak is geklasseerd omdat het te jonge kind niet verhoord werd.  Kinderen jonger dan drie jaar, worden in België nooit verhoord . Dit is de reden bij uitstek waarom daders hun  slachtoffers  almaar jonger uitkiezen. 


*Zaak is geklasseerd omdat het kleutertje de correcte benaming van de gebruikte seksspeeltjes niet kende  op het moment van verhoor.



*De onderzoeken zijn te duur, te tijdrovend. 



*Het slachtoffer had geen goed-adviserende advocaat .


*Het slachtoffer wist niet dat ze klacht moest indienen met Burgerlijke Partijstelling.


*De onderzoeksrechter voert hoofdzakelijk de onderzoeken uit die aangevraagd werden door de dader  en dus nutteloos waren.


*De dader zit in  een gevaarlijk netwerk  waar de onderzoeksrechter haar vingers niet aan wil branden, denk aan prostitutie, of  een crimineel die lid is van een bende.

Wanneer het slachtoffer of diens advocaat het toch zou wagen de waarheid te vertellen op de raadkamer, beland deze voor de correctionele rechtbank voor laster en eerroof, vaak nog eens met als extra aanklacht lasterlijke aangifte wat vaak resulteert in  een voorwaardelijke gevangenisstraf .     

Slachtoffers worden dus omwille van de wetgeving gedwongen om de zaak in de doofpot te stoppen wanneer er sprake is van een buitenvervolging van pedofilie of verkrachting .
