Rule of Law or Banana Republic?

#discussion Recently, the judge ruled that the curfewPer Direct from the table had to. Apart from whether you agree with the measure curfew or not. There was insufficient legal basis. In case of emergencies such as a dike breakthrough, curfew would be justified. In this case, not because there is no acute need.

Now in the Netherlands we have a separation of powers. Politics does not interfere with justice and vice versa. The Cabinet has always been very reluctant to. “As long as it's under court, we can't make any statements about this", that's what you (almost) always hear. And now our cabinet is doing so; interfering with the judge's verdict because it is bad. Then we just adapt the law so that it may, in the form of an emergency law, which is hung under the Corona Act.

Suddenly, the caselaw also goes along. Abolition of curfew,wrongly set by ademissionary cabinet, will be suspended until further notice. We have actually been wronged. This is ignored. An error should be fixed. I don't know how, but it just feels really awful.

How on earth is it possible that curfew will be abolished by law and then maintained, on the same day! I think that can only be done in a banana republic!

What a terrible thing, having to decide about things to do! There´s always, always, someone against the decision, but on the other hand there´s always, always, someone who agrees. And both parts have valid reasons. Always, always!🙂

@Paula Martins Yes, but the judge has spoken. But our government didn't like the outcome. So they rapidly changed the law. That's what i'm a little angry about...

The curfew setting tool was wrong, now other tools are being used that are legal. That's what the judge has to judge, and that's right.. The first law was political blunder, not the first time... Show more

@DiaantjesLife 🦋 Het klopt ook allemaal niet, net zoals Grapperhaus aanbleef, ondanks zijn blunder met z'n bruiloft. Daarom kreeg hij een strafblad. Een minister van justitie met strafblad mag niet, dus zou hij af moeten treden. Vandaar dat ze de boete ve... Show more

leo lo del amigo Enrique y me viene a la mente la diatriba politica entre oposición y oficialismo aca en Venezuela nos ha hecho mucho daño y nos sigue haciendo, pues se tranca la marcha del país, por no declinar en sus posturas ninguno de los dos bandos

well I have to say the prosecution is not always to follow. OK, the law wasn't right, but the Public Prophet should have known better in my eyes. That curfew is important.

@marijke Curfew is also important to me, but the fiddling when it turned out that it was not legally correct, a court decision and then soon something else cobbled together, I really do not think it is possible to. A judge should have the last word. After all, who explains the law.

Su tema me recuerda inequívocamente cómo también en mi país hay una separación de poderes, pero al mismo tiempo sólo un poder toma decisiones y ese poder es ilegal ante el pueblo y las propias leyes. La verdad es que suceden cosas tan incomprensibles que lo más saludable es no pensar en política a pesar de que sus decisiones nos afectan duramente.
